Help miss matched struts

Help miss matched struts
I bought a 5/2000 S40 with a bad strut bearing. Seller swapped out the driver sides with something and it's now an 1" higher on that side which doesn't look like passenger side. Also, passenger side sway bar thingy has rubbed away a 1/8" of the frame because of this.
Do I pay the previous owner $75 for an old strut assembly so they match or buy new so both sides are the same? Just not sure if early and late strut assembly matches up because driver side is at least an 1" higher.
Any advice will be greatly appreciated!

I'd call IPD USA or FCP Euro and ask. IPD specializes in suspension parts and knowledge. Call the 800 number. They have always been straight with me.
