s40 2011
A couple of things come to mind. Faulty gear shift sensor or PNP switch on trans or the switch itself. Also I believe you need your foot on the brake pedal but I could be wrong about that.

stuck in the ignition switch or stuck in the ignition on position??
Assume you mean stuck in the switch - so 1) make sure the steering wheel is not cranked to the side (putting pressure on the steering lock) 2) unlock the shifter (key on position, brake on, if needed use/pop out the unlock button.) 3) try the shifter row (top to bottom 20X) to clean the PNP sensor contacts.
