2003 Volvo V70 2.4L 3rd Row Seat

We have a 2003 V70 w/3rd row seat and the right side of the seat is not locking. It looks like the locking mechanism that slides down at the hinge isn't there. I'm not sure if it is always been like that or if its a new problem. Has anybody else experienced the same thing...how was it fixed?
