Default Ets issues... help!

I have a 99 2.4 Turbo (140k approx) that had a relatively new ETS module when I purchased from an individual in May (Was installed in Jan 10, now has under 10k on it).

Car had sluggish issues, but I purchased at a great price, so I thought I was ok...

I repaired the ABS module by soldering various cracked joints, and it's no longer bringing up codes..
Also put in new radiator, Nivomats, motor mounts, tires...

The ETS light started coming on sometime after I bought it, and I verified with the dealer that it was indeed recently replaced.

The car would drive very good, then next time sluggish.. mileage is about 17-18.. sometimes it is a powerhouse, other times, feels like I am driving up a steep mountain grade with the AC on.. It has always been most symptomatic on hotter days

Then it started idle issues, and severe shaking.. so, I took to dealer immediately.. They said that a hose to/from the module wasn't installed correctly, that should fix it..

They also said I needed AirMass Sensor, so.... we replaced it.. Drove out of dealer, still not liking it, as it was rough.... next day, it was glassy smooth, drove better than anytime since I have bought it, until......

It started being sluggish, and was for 2 days, then the ETS light came on again! Any help you can recommend?'

I know about the xemodex, and really like that idea, but this is a warranted part til Jan, and I hate to pay for a part that the dealer should make right...

I just didn't know if there was anything else to check, that would cause the ETS issues other than the throttle system itself.. I am going to take back to the dealer to try again, but want to be best informed when I talk to them..

I would keep bringing it back to them. They always try everything they can to get out of replacing them.
