Transmission problems on the horizon?

Question Transmission problems on the horizon?

Purchased my 2007 S60 on 12/31/09 certified Pre owned from a dealer in NJ. Car had @35k on it when purchased. Just recently I noticed that when shifting from Park to R or from N to D there was a sharp metallic "tink" noise from the Eng/trans area. Brought the car to a more local Volvo dealership (not the one I bought it from) and they looked at it.

They local dealer did a software upgrade to the trans and told me the tranny fluid "needed" to be changed as it was dark and had a very slight burn smell to it. I said go ahead as they were also doing an engine oil change as I had asked. The local dealer also didn't like the look of my left axle and will be replacing it under warranty in a few days (after part arrives) So $40 for the engine oil and filter change, which is ok, but $160 for the tranny?

So after I get the tranny fluid done, I'm thinking "Should this fluid have been changed when the selling Volvo dealer did the gazillion point CPO checklist?" The local dealer agreed that the fluid would not have changed color from good to bad in 4k miles over the last 3 and a half months. Volvo recommend's to change the tranny fluid every 50k or as needed. I'm thinking that the selling dealer should have changed it at the CPO inspection and should cover my cost to get it done.. Am I right?? I know that the Trans oil is supposed to be looked at for Condition/level/Leaks/Fill or Change Oil and Filters on Item 111 on the CPO Inspection Check list.

Additionally, local dealer said if the software upgrade, fresh fluid and new axle doesn't get rid of the "tink" noise (It hasn't so far but dealer said it may take a week for tranny to normalize to new fluid and software and axle has to be done yet) I may have to, worse case, get a new trans due to possible gear wear ?? It would be covered under the CPO warranty, but really a new Trans at 40K miles??

Any info would be appreciated
