Volvo V70 transmission problem

Volvo V70 transmission problem
I have a Volvo V70 T5 built in 2000, tiptronic, have owned since November 2009 and it has done approx 160,000kms.
I have a problem where once the car is nice and warm (say driving for an hour or so) it gets stuck in a gear (usually 4th). At first I thought the problem only happened in tiptronic but it has since happened in auto as well. If it happens in tiptronic, the gear display on the dash says 4th and the car won’t move out of this gear. But if I stop the car, turn off the key and then re-start, it goes back to normal but I have a transmission service light come on, and this stays on until I get it re-set with the Volvo computer at the garage. It seems that it is more likely to happen when I am accelerating, say passing another car or driving up a hill, usually hitting around 3000-4000 RPM so not crazy high revs or anything.
The problem did go away for a while after my mechanic discovered an oil leak within the engine, turned out it was oil breather box. He cleared all the excess oil out and the problem didn’t happen for 3 months or so. It has since returned, and there is also a small amount of excess oil within the engine again so it would seem that this oil is the source of the problem. The V70 Haines manual recommends getting the engine cleared of oil every 60,000 kms or so as it would seem this oil buildup is a known problem. I’m not sure where the oil is coming from as it could end up being a rather expensive expedition, possibly the turbo but it’s hard to be sure. It seems it’s easier to just deal with a bit of oil and get it cleared every so often as the Haines manual suggests. But my question is, is there a transmission sensor or something that could be getting clogged/confused by this oil and this is what is leading to the transmission slipping? Apparently the previous owner had the transmission rebuilt as it crapped out on him. The repair wasn’t done by a Volvo specialist and so they had to take it to the dealer afterwards to get codes cleared etc. Just thought it was worth mentioning.
Anyone got any ideas? It’s really frustrating, as you never know when it’s going to hit and it makes driving the car on long journeys a slightly apprehensive experience. It also means I can’t pass with confidence or really enjoy the car.

Lee
