2023 XC90 B5 (Mild Hybrid) frequent dead battery
I was reading through all the posts of the last year. There is a large group, a quite vocal group, who believes they are stuck with a lemon. Then there is a smaller group, perhaps less vocal who seems fine with a car with an obvious defect in their battery designs and seems content to develop various workarounds. My tendency is to side with the former and not the latter. Everyone seems to agree that there is a major flaw in the battery design causing dead batteries at the most opportune times causing various workarounds. I have to admit that I do not understand why anyone would pay about $70,000 dollars for a car and discuss workarounds to a dead battery. The Volvo XC90 2023, which I previously owned, is a good car. It is not a great car however and many other brands offer similar cars at similar prices without the baggage of a dead battery which everyone seems to agree does exist, except perhaps for Volvo who cannot admit the obvious or would be subject to a massive and expensive recall.
Update: I previously shared my situation here in April and started the Massachusetts lemon law process in May. In accordance with our state's legal provisions, a certified letter was dispatched to Volvo, granting them a final opportunity to address the issues. Unfortunately, Volvo's response exceeded the Massachusetts deadline by 20 days. This delay qualified me for lemon law arbitration, bypassing the manufacturer's customary opportunity for repairs.
Engaging directly with Volvo after this, proved unproductive until I submitted for arbitration with Massachusetts where they intervened took my case. Consequently, Volvo delegated the resolution process to a third-party company entrusted with overseeing the buyback. Negotiating with them demands a robust approach, and I am open to sharing advice with anyone navigating a similar situation. Notably, they do provide compensation for additional expenses, albeit with some resistance. It is a lengthy process as Volvo does not offer a buy back until the state takes the case. I started to use public transportation, ubers, lyfts and rental cars and was paid back for all of it.

Volvo just completed the buy-back of my car under NY state’s lemon laws.
Very disappointed in Volvo and Volvo Manhattan in their poor handling of this entire situation of a defective vehicle. I am fortunate that (living in Manhattan) I did not have a daily need for the car as it spent nearly 60 days at the dealership over a 12 month period. And, it was too unreliable and unpredictable to take on an overnight out of town trip. Over 12 months, I was only able to put 1,200 miles on the vehicle.
Already on to my next car, Mercedes EQE SUV 4Matic. So far an excellent experience and great range.
